Violation 1. Water Code section 13260: Staff verified through the California Integrated Water Quality System (CIWQs) database that there was no record of a submittal of a report of waste discharge or of obtaining coverage under the General Order for the Site. Violation 2. Threats of discharge of sediments and soils. The photos showed disturbed areas of exposed, native material in and around the Cultivation Sites which had been cleared of vegetation. Large fabric smart pots in these areas appeared to contain potting soil. The bare native material and potting soil of these areas and other areas of grading and disturbance are prone to erosion during storm events, and threaten to discharge downslope. Sediment and soils from these areas could be transported to the watercourses on the parcel, and then carried into the Class I Little Greenhorn Creek, located approximately 550 feet to the south. Additionally, staff utilized Google Earth Pro to estimate the ground slope at the Cultivation Site labeled CS-2 at approximately 24 percent. This steep slope on which the smart pots were placed will exacerbate the potential for erosion. Staff also noted a lack of installed Best Management Practices (BMPs) in the photos. These factors represent a threat of discharge to waters of the state.Violation 3. The improper storage and disposal of cultivation related debris, household garbage, and a general lack of housekeeping across the Site. The photos showed a variety of cultivation related debris and household garbage strewn across the site. This represents a threat of discharge to waters of the state. Violation 4. Water storage: Potential for leaks and failure causing discharge. The photos showed four large black poly water storage tanks. Should the tanks overflow, leak, or their plumbing connections fail, it could cause a catastrophic discharge event, impacting watercourses down slope. This represents a threat of discharge to waters of the state. |
