Violation 1. Water Code section 13260: Staff verified through the California Integrated Water Quality System (CIWQs) database that there was no record of a submittal of a report of waste discharge or of obtaining coverage under the General Order for the Site. Violation 2. Threats of discharge of sediments and soils. The photos showed disturbed areas of exposed, native material in and around the Cultivation Sites which had been cleared of vegetation. Large fabric smart pots in these areas appeared to contain potting soil. The bare native material and potting soil of these areas and other areas of grading and disturbance are prone to erosion during storm events, and threaten to discharge downslope. Sediment and soils from these areas could be transported to the watercourses on the parcel, and then carried into the Class I Little Greenhorn Creek, located approximately 550 feet to the south. Additionally, staff utilized Google Earth Pro to estimate the ground slope at the Cultivation Site labeled CS-2 at approximately 24 percent. This steep slope on which the smart pots were placed will exacerbate the potential for erosion. Staff also noted a lack of installed Best Management Practices (BMPs) in the photos. These factors represent a threat of discharge to waters of the state.Violation 3. The improper storage and disposal of cultivation related debris, household garbage, and a general lack of housekeeping across the Site. The photos showed a variety of cultivation related debris and household garbage strewn across the site. This represents a threat of discharge to waters of the state. Violation 4. Water storage: Potential for leaks and failure causing discharge. The photos showed four large black poly water storage tanks. Should the tanks overflow, leak, or their plumbing connections fail, it could cause a catastrophic discharge event, impacting watercourses down slope. This represents a threat of discharge to waters of the state. |

Discharge of sewage to the bare ground surface at a pit toilet. The pit toilet measured approximately 35 feet away from a Class I watercourse. Discharge of gray water from an outdoor kitchen area. The bare ground surface next to the kitchen area had a noxious smell and was covered with food waste scraps and gray water. Bare soils of the disturbed and cleared areas in and around the hoop houses, exposed cut and fill slopes, and graded pads and terraces that were constructed of bare native soil material and lacked Best Management Practices (BMPs). Potential discharge from piles of potting soil. These areas are likely to erode and discharge sediment and soils during storm events. Improper storage of equipment, fuels, chemicals, and nutrients. This includes three gasoline powered generators, seven gasoline powered water pumps, various fuel containers, nutrient containers, chemical fertilizers in sacks and buckets, and other chemicals. All of these items were improperly stored on the bare ground surface across the site, and without adequate cover from the elements. Unimproved access roads constructed of native soil material which lacked any type of armoring or Best Management Practices (BMPs) and were likely to erode and discharge during storm events. Unsecured and improperly stored trash and debris, to include unsecured piles of plastic sacks filled with household garbage, household garbage that was strewn across the bare ground surface, lumber, scrap metal, plastic and metal pipe, plastic tarps, plastic chemical and fertilizer containers, smart pots, and miscellaneous cultivation and construction related debris. Water storage and related infrastructure which threatens to cause discharge. This included a 2800-gallon water tank and three Intermediate Bulk Containers (IBCs). |

Discharge of sewage from a port-a-potty. The port-a-potty appeared to be leaking sewage directly to the ground surface underneath. Discharge of a variety of cultivation related debris and slash that had been placed into the Class III watercourse. This included cardboard, PVC pipes, plastic netting and tarps, plastic sacks filled with trash, potting soil, and waste plant material. Bare soils of the disturbed and cleared areas around the hoop houses, and materials of the graded pads and other graded areas which lacked BMPs to prevent discharge of sediment and soils to nearby waters of the state. Improper storage of equipment, fuels, chemicals, and nutrients, including a gasoline powered generator, gasoline powered water pumps, fuel containers, propane cylinders, nutrient containers, chemical fertilizers in sacks and buckets, and fuel containers. All of these items were improperly stored on the bare ground surface across the site. Unimproved access roads across the Site which lacked any type of armoring or Best Management Practices (BMPs). Unsecured and improperly stored trash and debris, to include household garbage, chemical and fertilizer containers, plastic garbage bags filled with trash, scrap PVC and black poly piping, plastic tarps, lumber, plastic grow pots, waste plant material, and miscellaneous cultivation and construction debris. Water storage and related infrastructure which threatens to cause discharge. |

Bare soils of the disturbed and cleared areas around the hoop houses, and materials of the graded pads and other graded areas which lacked BMPs to prevent discharge of sediment and soils to nearby waters of the state. A ditch cut into the native material on the west side of the CA and areas around the hoop houses, which drained into the nearby Class III watercourse, discharging sediment. Failing wooden planter boxes filled with potting soil, which have the potential to discharge into the nearby Class III watercourse. Water storage and related infrastructure which threatens to cause discharge. |
