1067589 11/26/2019 Enforcement Action Notice of Violation The facility at 33100 Fernandez Road, in the City of Nuevo (WDID No. 8 365983001), is authorized to discharge pollutants in storm water runoff subject to the conditions and provisions of NPDES Permit No. CAG18001, General Waste Discharge Requirements for Concentrated Animal Feeding Operations (Dairies and Related Facilities) within the Santa Ana Region (General Permit). Regional Board staff has determined that Jim Bootsma Jr. Dairy has violated conditions and provisions of the General Permit. The basis for this determination is outlined below. Regional Board staff conducted a series of inspections on November 1, November 4, November 15, November 18, November 20, and November 22, 2019 of the facility in accordance with Section V.A.1 of the General Permit. As a result of the inspections, Regional Board staff established the following: ¿ On November 1, 2019, Regional Board staff observed approximately 16 calf carcasses within the San Jacinto Riverbed directly behind your facility. You explained that coyotes had dragged the remains to the San Jacinto Riverbed. Regional Board staff direct you to remove the animal remains for proper disposal on November 4, 2019. Regional Board staff confirmed that the remains had been removed on November 15, 2019. ¿ On November 1, 2019, Regional Board staff first observed wastewater within the San Jacinto Riverbed. You stated on November 4, 2019 that the wastewater leaked from a gopher hole that you had been meaning to fix. On November 15, 2019, you stated that you fixed the leak. When asked how the leak was fixed, you explained that you stopped putting wastewater into the containment pond and redirected wastewater into a different pond. You did not indicate that the cause of the leak had been mitigated. ¿ On November 15, 2019, Staff directed you to remove the wastewater from the San Jacinto Riverbed. During the November 18, 2019 follow up inspection, Regional Board staff found wastewater in the San Jacinto Riverbed. Regional Board staff directed you again to remove the water from the San Jacinto Riverbed that day and informed you that rain was forecast later that week on November 20th. ¿ On November 15, 2019, Regional Board staff observed that manure had been placed on both the bank and in the riverbed of the San Jacinto River. You stated that you were not aware of the manure. Staff directed you to remove the manure as it was not permissible to dispose of manure in the San Jacinto Riverbed. ¿ On November 18, 2019, Regional Board staff observed that the manure removed from the bank and riverbed had been spread on the northern perimeter road of Jim Bootsma Jr. Dairy. You stated that you had applied the manure to the road for dust control. Staff informed you that it was not permissible to spread manure on the northern perimeter road. Staff directed you to remove the manure from the road for disposal. The November 22, 2019 inspection revealed that only part of the manure had been removed. ¿ On November 20, 2019, Regional Board staff conducted an inspection and asked if you had removed the water. You stated that you had rented a pump and removed the water until the bed was dry. You then stated that the area had received an inch of rain overnight and that, if there was water in the riverbed, it was because of the rain. Regional Board Staff inspected the riverbed and found wastewater in the same locations previously noted and nowhere else in the riverbed. ¿ On November 1, 4, 15, 18, 20, and 22, Regional Board staff observed that the spill ways for the containment basins were filled in with soil and were not useable as intended in the EWMP.
