Water Code Section 13260 Violation ? Potential discharge of waste from commercial cannabis cultivation activities to waters of the state prior to filing a report of waste discharge. Central Coast Water Board staff observed the following conditions at the Site: disturbed cannabis cultivation areas and associated infrastructure, and irrigation materials and equipment that lacked best management practices (BMPs) to prevent the discharge of materials to nearby waters of the state; fertilizers, pesticides, chemicals, and miscellaneous refuse and debris throughout the Site, that were improperly stored and lacked secondary containment to prevent discharges to nearby waters of the state. These conditions represent a violation of Water Code 13260, because the Dischargers created a condition of potential discharge of waste that could affect the quality of waters of the state, without having filed the required report of waste discharge to obtain permit coverage. |
