On 23 December 2022, the Central Valley Water Board issued a Water Code 13267 Order (13267 Order, enclosed) to the Dischargers. The 13267 Order stated that there is no approved Title 22 Engineering Report for the reuse of recycled water to the COGC and required the Dischargers to develop and submit a Title 22 Engineering Report compliant with all applicable requirements of Title 22 no later than 15 March 2023. The submittal is now 455 days late. |

Unauthorized Discharge |
During the inspection of the Town Field, including the tailwater control and return systems, the following violations of the WDR conditions were confirmed: ?Water Recycling Specification G.12: All storm water runoff from the LAAs shall be captured and recycled for irrigation or allowed to percolate within the use areas.? At the time of the inspection Regional Board staff observed a large amount of tailwater pooled along the tailwater control berm on the southeast and south boarders of the Ione wastewater treatment facility LAAs designated the ?Town Field?. Further into the inspection Regional Board staff observed that the tailwater return vault was underwater and the valve was shut off. The Discharger was knowingly not complying with conditions of the WDRs nor implementing their best management practice of returning excess tailwater back to the plant. Board staff also inspected the tailwater control berm, which had been breached and failed in numerous places along the southwest and southern boarders of the Town Field. On the southeastern boarder of the Town Field discharging tailwater was leaving the LAA and flooding the adjacent pastureland to the west of the Town Field. |

Order Conditions |
1. It does not appear disinfection has been added to the treatment train as required by the WDRs. This is a violation of Discharge Specification E.4 and Provision I.1.a of the WDRs: Discharge Specification E.4: ¿The City shall operate all systems and equipment to optimize the quality of the discharge.¿ Provision I.1.a: ¿By 31 December 2013, the City shall submit a Phase I Improvements Completion Report (Phase I includes a disinfection contact chamber, see Finding 18) that certifies construction and start-up testing of the new wastewater treatment system and recycling sites have been completed, and certifies that the WWTF can comply with the applicable effluent limitations. The report certify that the improvements were constructed as described in the RWD and this Order, and shall include as-built drawings of the WWTF and recycling site improvements.¿ |
