On January 8, 2021, the Regional Water Board Executive Officer directed MRC to submit the technical report by February 1, 2022, pursuant to Water Code section 13383. The report required technical information on the Facility?s vulnerabilities to sea-level rise, groundwater rise, changing climate, and power outages, and associated adaptation strategies. On January 25, 2022, MRC requested a four-month extension of the deadline to June 1, 2022. The Executive Officer granted this request on January 27, 2022. However, MRC did not meet the extended deadline and did not submit the technical report until October 10, 2023. |

Unauthorized Discharge |
On June 7, 2023, the Discharger allegedly discharged 471,100 gallons of partially primary-treated process wastewater to a water retention area hydrologically connected to McNabney Marsh. The discharge occurred as a result of a break in a cement-encased pipeline that was not discovered until water was observed spilling from the section of the pipeline where the break occurred. The Discharger was unable to clean up 328,314 gallons of the unauthorized discharge. |

Deficient Monitoring |
The NPDES permit requires WQCP to monitor pH at the E-001 site. Since June 1, 2023, WQCP has implemented real-time pH monitoring at E-001 using a HACH Digital pH sensor (model #: DPD1P1), with data transmitted to SCADA via the HACH controller (model#: SC200). In November 2024, technical issues with the controller caused data transmission failures on 7 days, resulting in 3 days with data gaps more than 60 minutes and the total time of data gaps during the calendar month more than 7 hours and 26 minutes. These conditions are specified for compliance determinations using a continuous monitor (Order No. R2-2019-0021, Table 4, footnote 1). Despite the missing data, the effluent pH remained within the compliance range of 6-9 s.u., as confirmed by the upstream pH analyzer, located after the aeration basins and before the secondary clarifiers. The upstream analyzer typically records pH values similar to those measured at E-001 and demonstrated consistent compliance within the 6.0¿9.0 range throughout the month. A thorough investigation was conducted by the Lead Plant Mechanic Kenneth de Leon and Lead Operator Ryan Estrada. Hardware, communication, environmental, and SCADA-related causes were ruled out (see table below). However, software glitches or bugs remain a possible, undetermined factor. It was observed that when the analyzer sent a warning signal to the controller, data transmission between the controller and SCADA is paused. |

The BOD sample collected on January 31st was submitted to the analytical laboratory 5 hours outside of its 48-hour hold time. Although analyzed outside of hold time, the results showed that the sample was in the normal range for our E-001 BOD (3.95 mg/L), and was an order of magnitude below our average weekly NPDES permit limit (45 mg/L). |

Around 10:00 am, the Discharger made the decision to pump the preliminary treated wastewater out of the equalization tank and into a nearby storm drain to minimize the risk of damage to the Plant equipment. The influent flows gradually decreased as the day went on, with the unauthorized discharge ceasing around 9:00 pm. |

On July 29, 2022, MRC sampled for coliform at EFF-001D as dictated by its random sampling schedule. The sample was sent to a contract laboratory, but the driver did not deliver the sample within the 8-hour hold time. MRC was notified of the hold time exceedance on Monday, August 1, 2022. The compliance week as defined in Order R2-2017-0039 is Sunday to Sunday meaning that MRC was not able to take an additional sample to meet the weekly monitoring requirements for coliform for the week of July 24, 2022. The coliform analysis for the July 29 sample was completed but it was not reported in CIWQS due to the qualifier of not meeting regulatory hold time requirements; the result was 2 MPN/100 mL. MRC verbally notified the Regional Water Quality Control Board of the monitoring deficiency on Monday, August 1, 2022. |
