Order Conditions |
Violation of Order section III.A. "The discharge of waste from the SRTTP not treated by a secondary treatment process and/or not in compliance with the effluent limitations specified in section IV.A of this Order, and/or to a location other than Discharge Point No. 001, unless specifically regulated by this Order or separate WDRs, is prohibited." The discharge of treated wastewater containing PFAS through the reclaimed water system pursuant to WDRs R9-2018-0023 violated section II. Discharge Prohibitions section A. Discharge of waste, other than incidental runoff, to lands which have not been specifically described in this Order or in the ROWD, and for which valid waste discharge requirements are not in force are prohibited. |

Basin Plan Prohibition |
Unpermitted Discharge of a Pollutant to Waters of the U.S. in violation of Clean Water Act section 301 and Water Code section 13376. On June 19, 2023, San Diego Water Board staff observed and documented evidence of excavating and grading within Temecula Creek, waters of the United States, and state. These excavating and grading activities in and around Temecula Creek resulted in the discharge of waste (sediment and soil) into Temecula Creek, waters of the United States, and state. The discharge of sediment and soil (wastes) pollutes surface waters, adversely affects aquatic life, and obstructs the aesthetic enjoyment of surface waters. The discharge of sediment and soil threatened to unreasonably affect beneficial uses of Temecula Creek, waters of the U.S. and state, and downstream waters, including habitat and ecosystem-related beneficial uses, and caused or contributed to pollution or nuisance conditions. Based on these observations, the Dischargers failed to prohibit the discharge of waste to waters of the state in a manner causing, or threatening to cause a condition of pollution, contamination, or nuisance. |

Unauthorized Discharge |
Failure to obtain Waste Discharge Requirements for the filling of wetlands in violation of Clean Water Act section 401 and Water Code section 13376. The State of California largely relies on Clean Water Act section 401 (33 U.S.C. § 1341) to regulate discharges of dredged or fill material to waters of the U.S. and state. Clean Water Act section 401 requires an applicant to obtain ?water quality certification? from the state that the project will comply with state water quality standards before certain federal licenses or permits may be issued. The permits subject to Clean Water Act section 401 include permits for the discharge of dredged or fill materials (Clean Water Act section 404 permits) issued by the U.S. Army Corps of Engineers. Available evidence indicates that there are wetland waters of the U.S. on the Site that meet the federal wetlands definition. Based upon this, a search of the San Diego Water Board?s files, and the County?s inspection observations and documentation, the Dischargers failed to obtain a Clean Water Act section 404 permit and a water quality certification under Clean Water Act section 401 for their grading activities at the Site. |

Basin Plan Prohibition |
Prohibition No. 14 states that ?[t]he discharge of sand, silt, clay, or other earthen materials from any activity, including land grading and construction, in quantities which cause deleterious bottom deposits, turbidity or discoloration in waters of the state or which unreasonably affect, or threaten to affect, beneficial uses of such waters is prohibited.? On September 27, 2022, County staff observed and documented evidence of excavating and grading within Temecula Creek, ?waters of the United States? and state. These excavating and grading activities in and around Temecula Creek resulted in the discharge of waste (sediment and soil including sand, silt, clay and other earthen materials) into Temecula Creek. Dischargers activities disturbed earthen materials in and around Temecula Creek, and discharged these wastes into Temecula Creek and in the vicinity where they were likely to be discharged. Over the last year, the Site has experienced greater than normal rainfall that increased the potential for the discharge of waste to Temecula Creek and environmental harm. The discharge of sediment and soil (wastes) pollutes surface waters, adversely affects aquatic life, and obstructs the aesthetic enjoyment of surface waters. The discharge of wastes threatened to unreasonably affect beneficial uses of Temecula Creek, and downstream waters, including habitat and ecosystem-related beneficial uses, causing deleterious bottom deposits, turbidity and discoloration of Temecula Creek. |

Basin Plan Prohibition |
Prohibition No. 7 states that ?[t]he dumping, deposition, or discharge of waste directly into waters of the state, or adjacent to such waters in any manner which may permit its being transported into the waters, is prohibited unless authorized by the Regional Board.? On September 27, 2022, County staff observed and documented evidence of excavating and grading within Temecula Creek, ?waters of the United States? and state., These excavating and grading activities in and around Temecula Creek resulted in the dumping, deposition, and discharge of waste (sediment and soil) in and adjacent to Temecula Creek, ?waters of the United States?. Subsequent rain events and elevated flows occurred in Temecula Creek, allowing the waste to be transported downstream. |

Prohibition No. 3 states that ?[t]he discharge of pollutants or dredged or fill material to waters of the United States except as authorized by an NPDES permit or a dredged or fill material permit (subject to the exemption described in Water Code section 13376) is prohibited.? On September 27, 2022, County staff observed and documented evidence of excavating and grading at the Site within Temecula Creek, ?waters of the United States.? These Site excavating and grading activities in and around Temecula Creek resulted in the discharge of pollutants (sediment and soil) into Temecula Creek, ?waters of the United States.? Furthermore, a search of San Diego Water Board and U.S. Army Corps of Engineers? records on March 29, 2023, failed to find any permits for these activities. |

Prohibition No. 1 states that ?[t]he discharge of waste to waters of the state in a manner causing, or threatening to cause a condition of pollution, contamination or nuisance as defined in Water Code section 13050, is prohibited.?
