Executive Summary The City of Burlingame (City) has a formal pretreatment program but does not have any significant industrial users (SIUs) as defined at Title 40 of the Code of Federal Regulations (CFR) section 403.3(v). The Citys representatives have a good general grasp of the pretreatment program requirements and the Citys nondomestic dischargers. Several legal authority deficiencies, however, were noted. The City has not revised its sewer use ordinance (SUO) to incorporate the required streamlining rule provisions. The SUO also allows that nondomestic discharger reports can be submitted up to 60 days late before the discharger is considered to be in significant noncompliance (SNC). The City must revise its SUO and ensure that its enforcement response plan is consistent with the revised SUO. 2. Introduction The San Francisco Bay Regional Water Quality Control Board (Water Board), with assistance from Tetra Tech, Inc., conducted a pretreatment compliance inspection (PCI or inspection) of the Citys pretreatment program on December 15, 2010. The last inspection of the Citys pretreatment program had been performed in January/February 2006. This report describes the primary concerns generated by the 2010 inspection. The file of one of the Citys nondomestic dischargers was reviewed during the inspection: Sees Candies, Inc. (non-SIU) The following discharger was visited during the PCI: Guittard Chocolate (non-SIU) 3. Description of Pretreatment Program The City has no industrial users that are considered SIUs or categorical industrial users (CIUs). In 2005 the City declassified its eight SIUs to commercial discharger status for various reasons including low flow and minimal effect on the wastewater treatment facility, compliance with former permit requirements, and lack of process wastewater discharge. The Water Board approved that modification by acknowledging the Citys 2005 semiannual report, which identifies the change as the formal document granting approval of the Citys request to reclassify its SIUs. The Citys pretreatment program consists primarily of a strong fats, oil, and grease (FOG) program that oversees 143 non-SIUs, including primarily food service and hospitality establishments. The City has one permitted groundwater remediation site. Veolia Water is contracted to support the Citys pretreatment program. The City owns and operates a wastewater treatment facility that provides treatment for a population of approximately 28,000 in the City and a population of 6,000 in the town of Hillsborough. In addition, another 1,000 are provided service in unincorporated areas of San Mateo County bringing the total service population to approximately 35,000. The wastewater treatment facility has an average dry-weather flow design capacity of 5.5 million gallons per day. The City does not receive hauled waste at its wastewater treatment facility. 3.1 Pharmaceutical Take-Back Efforts The City initiated a pharmaceutical take-back program in 2004. Collection containers are in the police station, and the public is allowed to anonymously deposit pharmaceuticals. The containers fill up twice a week, which is approximately 35 gallons of unused pharmaceuticals collected weekly. The collected pharmaceuticals are disposed of through incineration. 3.2 Dental Mercury The City has a dental mercury amalgam oversight program and conducted an inventory of dental amalgam practitioners in the service area, which revealed that ISO-certified amalgam separators are already installed, and appropriate best management practices are being implemented to minimize discharge of mercury in the wastewater. Site inspections are planned for late 2011. The City has approximately 23 dental practitioners working out of 17 dental offices. The City does not issue permits to dentists. Evaluation of mercury levels in the effluent of the WWTP has shown a decrease from 2009 to 2010. This may or may not be a direct result of the dental amalgam program. The inspection team recommends the City consider tracking pounds of amalgam removed in an effort to evaluate the true success of the program. 3.3 Industrial Laundries The City does not have any industrial laundries. Royal Linens, which catered to hotels, moved to Los Angeles and only small coin-operated laundries remain. If an industrial laundry facility moves to the Citys jurisdiction, the City should encourage the facility to participate in the Safer Detergents Stewardship Initiative (http://www.epa.gov/dfe/pubs/projects/formlat/sdsi.htm). 3.4 Performance Measures The City has a formal FOG program and an aggressive root foaming program. The City added an additional vactor truck for cleaning hot spots in the downtown area. The City contracts out any FOG-related blockages for cleanup and repair. It has been 3 years since the City has experienced a grease-related sanitary sewer overflow or other major blockage caused by non-domestic dischargers in the collection system. Staff members from the street and sewer division report a downward trend of FOG-related sewer overflows. City pretreatment program representatives were unaware of corrosion problems in the collection system because its maintenance is not under their purview. They noted that the City has purchased closed circuit television cameras for evaluating the condition of the collection system and has purchased a vactor truck. As noted above, the City does not have any SIUs; therefore, metrics for how many SIUs are in 100 percent compliance or are zero-dischargers are not applicable. 3.5 Potential Cleanup Sites City personnel report that they are not aware of any potential cleanup sites in the Citys jurisdiction. The City should continue to assess whether any facility appears to be a marginal operation that might close and leave a cleanup needing public funding. 4. Pretreatment Program Modifications The federal pretreatment regulations at 40 CFR 403.18 require the City to notify the Water Board of any modifications it intends to make to its pretreatment program. As noted above, the City modified its program to declassify its SIUs to commercial users. The Water Board approved this modification in 2005. 5. Legal Authority The federal pretreatment regulations at 40 CFR 403.8(f) require that every POTW subject to the national pretreatment program have the necessary legal authority to apply and enforce section 307(b) and (c) and section 402(b)(8) of the Clean Water Act. In addition, on October 13, 2005, EPA promulgated several changes to the general pretreatment regulations (streamlining rule). Three changes are required in the POTWs legal authority if the streamlining changes are more stringent than the pretreatment programs current requirements. Those required changes are the following: 40 CFR 403.8(f)(1)(iii)(B)(6): clarification that slug control requirements must be referenced in SIU control mechanisms 40 CFR 403.8(f)(2)(viii)(AC): revisions to the SNC definition 40 CFR 403.12(g): modifications to the sampling requirements and clarification of the requirement to report all monitoring results A review of the Citys SUO was performed to determine whether the required streamlining rule revisions are incorporated. They are not, and the City is required to revise its SUO to include the requirements. The Citys SUO does not contain the legal authority to require that slug control requirements be placed in SIU permits as required at 40 CFR 403.8(f)(1)(iii)(B)(6). The Citys definition of SNC is not the same as the definition at 40 CFR 40 CFR 403.8(f)(2)(viii), and the Citys SUO allows 60 days before late reports cause the nondomestic discharger to be in SNC. The federal regulations at 40 CFR 403.8(f)(2)(viii)(F), however, allow only 45 days. Furthermore, the Citys SUO does not include the revisions at 40 CFR 403.12(g)(3), which include specific sample type requirements and 40 CFR 403.12(g)(4), which requires that all monitoring results be reported to the POTW. Nondomestic Discharger Characterization The federal pretreatment regulations at 40 CFR 403.8(f)(2) require that POTWs develop and implement procedures to identify and locate industrial users that might be subject to the local pretreatment program. Those procedures must also include proper categorization of all SIUs as defined at 40 CFR 403.3(v). The inspection team found the Citys process for identifying and locating new nondomestic dischargers to be adequate. All new business license applications are forwarded to wastewater treatment facility staff. City personnel inspect each new facility before and after a license is issued to determine how the facility should be categorized. In addition, they also inspect existing facilities to determine whether there has been any change in water usage. 7. Control Mechanisms To ensure compliance with applicable pretreatment standards, the federal pretreatment regulations at 40 CFR 403.8(f)(1)(iii) require POTWs to control the discharges from nondomestic dischargers by using control mechanisms (permits or other similar means). As previously stated, the City had requested that all SIUs permitted at the time of the previous pretreatment compliance inspection be reclassified as commercial dischargers and not be considered SIUs. Subsequently, the City has issued a commercial discharg permit to each facility previously classified as an SIU. The inspector reviewed one non-SIU permit to determine whether it complies with pretreatment program requirements. The permit for Sees Candies contains all required permit components at 40 CFR 403.8(f)(1)(iii). 8. Compliance Monitoring The federal pretreatment regulations at 40 CFR 403.8(f)(2)(v) require that a POTW develop and implement an inspection and monitoring program to determine, independent of information supplied by nondomestic dischargers, compliance or noncompliance with applicable pretreatment standards and requirements. Furthermore, 40 CFR 403.8(f)(2)(vi) requires POTWs to investigate instances of noncompliance and enforce the regulations as necessary. 8.1 Compliance Sampling The federal pretreatment regulations at 40 CFR 403.8(f)(2)(v) require that all SIUs be sampled at least once a year. Even though the City does not have any SIUs, it is strongly recommended that the City conduct compliance monitoring at its commercial facilities a minimum of once per permit cycle to insure compliance with established local limits. 8.2 Compliance Inspections The federal pretreatment regulations at 40 CFR 403.8(f)(2)(v) require that all SIUs be inspected at least once a year. The City does not have any SIUs and is not required to conduct inspections as required at 40 CFR 403.8(f)(2)(v) at its commercial facilities. The City does, however, conduct inspections of grease traps at its commercial facilities under its FOG program to ensure they are working properly and have been well maintained, and pumping records are available for review. 8.3 Nondomestic Discharger Site Inspections Conducted During the Inspection The Tetra Tech inspector, along with City personnel, inspected one of the permitted nondomestic dischargers as part of the inspection. The Tetra Tech inspector noted the following during the nondomestic discharger site visit: Guittard Chocolate. The facility is a chocolate manufacturer that produces approximately 1.5 million pounds of chocolate, liquor, and powder per day. The facility manufactures approximately 300 different products. Cocoa beans are sorted, cleaned, and de-stoned before being roasted and broken. The broken beans are processed in a granite liquor mill. The liquid is then pressed and shipped out (as liquor), made into cocoa butter, or further processed in a refinery with sugar and cream or milk. There are three refinery lines for different types of candy making. The chocolate paste is then processed for 1620 hours in a conch machine to remove harmful volatiles before being molded into chocolate and cooled. Washdown water from the molds, machines, and truck-loading area is discharged to the facilitys pretreatment system. Cooling tower blowdown water is discharged to the sanitary system but is not pretreated. The facility uses a dissolved air flotation unit to pretreat the wastewater. The dissolved air flotation unit tank holds 12,000 gallons, and the sludge tank holds 1,200 gallons. The unit is run once or twice a week, and the sludge tank is pumped approximately every 2 weeks. No deficiencies were noted during the site visit. 9. Enforcement The federal pretreatment regulations at 40 CFR 403.8(f)(5) require the City to develop and implement an enforcement response plan. That plan must contain detailed procedures indicating how the City will investigate and respond to instances of industrial user noncompliance. The City has adopted an enforcement response plan titled Guidelines for Enforcement and Monitoring Under the Industrial Waste Discharge Program. The enforcement escalation process described by City personnel during the inspection consists of pretreatment staff notification to the Public Works Department of a problem and the proposed corrective action. Then the City attorney and Public Works director provide direction on how to proceed. Enforcement actions such as notices of violation, administrative orders are sent to the nondomestic discharger by the Citys Environmental Compliance supervisor. As discussed in Section 5, the City is required to modify its SUO to decrease the timeline for late reports from 60 days to 45 days as required at 40 CFR 403.8(f)(2)(viii)(F). The City must also ensure that its enforcement response plan is consistent with that revision and modify it, if necessary, to change the timeline from 60 days to 45 days for designation of SNC. Summary of Requirements Listed below are the primary requirements resulting from the inspection of the Citys pretreatment program. For more specific information pertaining to each comment, see the cited sections of the report. 10.1 Requirements The City has not revised its SUO to incorporate the requirements required by the streamlining rule. The City must revise its SUO to include provisions at 40 CFR 403.8(f)(1)(iii)(B)(6) [clarification that slug control requirements must be referenced in SIU control mechanisms]; 40 CFR 403.8(f)(2)(viii): revisions to the SNC definition, and late report timeline; and 40 CFR 403.12(g)(3)&(4) [specific sample type requirements and 40 CFR 403.12(g)(4), which requires that all monitoring results be reported to the POTW.] (Section 5, Legal Authority) The City must ensure that its enforcement response plan is consistent with the SUO, and modify it, if necessary, to change the timeline from 60 days to 45 days for designation of SNC.
