The inspection was conducted to evaluate the drainage and erosion control systems at the site in accordance with Order No. 98-99. Present during the inspection was Sandra Green and Paul Dufresne, representing the County of Riverside. The site was in fair condition with some minor erosion on the bench roads and a small sinkhole on the south side of the landfill adjacent to the main haul road. However, Board staff observed a moderate amount of landfill gas condensate overflowing from the top of a gas condensate storage tank located adjacent to the landfill gas flair station. As a result of this containment failure, landfill gas condensate flowed in a northwesterly direction approximately 200 to 250 feet from the tank onto native ground, commingling with storm water and possibly discharging off-site. This is to notify you that the discharge of landfill gas condensate off-site is an unauthorized discharge that is in violation of the following discharge prohibitions contained in WDR Order No. 98-99: Discharge Specification B.2.g of Order No. 98-99, which states: The operation of a municipal solid waste facility shall not cause a discharge of pollutants into waters of the United States, including wetlands, that violates any requirements of the Clean Water Act, including, but not limited to the National Pollutant Discharge Elimination System (NPDES) requirements, pursuant to Section 402. Discharge Prohibition A.1 of Order No. 97-03-DWQ, National Pollutant Discharge Elimination System (NPDES) General Permit No. CAS000001, which states: Except as allowed in Special Conditions (D.1.) of this General Permit, materials other than storm water (non-storm water discharges) that discharge either directly or indirectly to waters of the United States are prohibited. Prohibited non-storm water discharges must be either eliminated or permitted by a separate NPDES permit. This letter constitutes a Notice of Violation for the unauthorized discharge of gas condensate from the landfill site. Therefore, immediate action must be taken to bring the site into compliance with both orders. As part of your requirements for bringing the site into compliance, the following remedial action steps must be taken: Remove and properly dispose of all soil that was affected by the gas condensate spill. Because gas condensate may have traveled at least 250 feet away from the tank, soil testing may be necessary to assure that all contaminated soil is cleaned up. Once the affected soil has been removed, soil samples of the affected area must be collected and analyzed to verify that all gas condensate contaminated soil has been removed. Submit a workplan indicating what measures will be taken to avoid future gas condensate spills. We suggest that the workplan focus on tank capacity and an alarm system that will notify staff of impending containment failures. A report verifying that the landfill gas condensate spill has been remediated must be submitted to our office by March 16, 2005. The report should include the analytical results of the soil samples, estimated gallons of condensate spilled, and the location where the gas condensate-contaminated soil was disposed of. The workplan for eliminating future landfill gas condensate spills should be submitted to our office by April 5, 2005. Please be advised that it is imperative that action be taken to correct the deficiencies at the site. A second occurrence of this violation may result in enforcement action, including the assessment of monetary penalties.
