Deficient BMP Implementation |
• Evidence of the unauthorized non-storm water discharge observed at multiple locations of the facility constitutes a failure to eliminate all unauthorized non-storm water discharges which is a violation of Section III.E.1.c.1.b.x;
• The unavailability of the REAPs violates Section III.E.1.c.1.b.vi;
• Undocumented discharge points constitutes the failure to document all discharge points on the site map in the SWPPP in violation of Section III.E.1.c.1.a;
• The failure to update the SWPPP is a violation of Section III.D.3;
• Failure to collect samples from the onset of the discharge violates Section IV.B.3 of the Monitoring and Reporting Program of the Scrap Metal Permit; and,
• The failure to submit all sampling results to SMARTS within 30 days of receipt of laboratory results violates Section VII.B of the Monitoring and Reporting Program of the Scrap Metal Permit.
