1115800 01/10/2023 DMON The Facility's NPDES Permit requires effluent discharge monitoring, sampling, and visual observations when there is a discharge event. Due to severe weather and road closures, Cemex was unable to access the Facility and fulfill this requirement for the discharge event which occurred on January 10, 2023, which constitutes a non-compliance. A significant amount of sediment was deposited in the debris basins during the January 10th storm event. Once the water percolates into the ground and the basins are accessible to heavy equipment, Cemex will dredge the sediment from the debris basins. The earthen berm across the concrete spillway, where Discharge Point 001 and the flow meter were located, was washed out. Once the water percolates into the ground and the basin is accessible to heavy equipment, Cemex will rebuild the earthen berm and replace the flow meter. Cemex is evaluating methods to rebuild the berm and discharge pipe to better withstand the potentially high velocity flow of water that could be experienced during storms which are severe enough to result in a discharge. Storm water discharging from DB-8 destroyed a portion of the concrete spillway and carved a gully beneath the spillway. Once the area is sufficiently dry and accessible to heavy equipment, Cemex will fill in the gully and rebuild the damaged portion of the concrete spillway. To increase the Site's storm water storage capacity while the debris basins and discharge point are pending repair, Cemex will temporarily channel storm water from the upper five basins to the quarry pit during rain events, significantly reducing the volume of storm water from flowing to DB-8.
