S876909 03/23/2021 Deficient BMP Implementation After performing an inspection of the Project, and after looking at it in its entirety, missing and unmaintained BMPs were observed. Also observed was a failure of the BMPs to function together effectively in order protect water quality and thus it is concluded that the Project's controls have failed to achieve the minimum technology-based standard of BAT/BCT. S876910 03/23/2021 Deficient BMP Implementation The inspector witnessed uncontrolled non-stormwater discharges from drilling activities that were occurring during the inspection for the eventual construction of a bridge that would cross over San Marcos Creek at this location. At the time of the March 23, 2021, inspection, the Discharger failed to implement measures to control all non-stormwater discharges during construction. The Discharger, in response to the San Diego Water Board inspection report, stated that non-stormwater BMPs were installed on April 15, 2021. Violation B Inspection
S876915 03/23/2021 FOP Photos 17 and 18 of the Inspection Report show the discharge of street sweeper waste on the Project within the floodplain of San Marcos Creek. Discharges of solid waste to land require separate Waste Discharge Requirements (WDRs). The Discharger did not file a ROWD for these discharges with the San Diego Water Board; therefore, these discharges are unauthorized and un-permitted. Violation B Inspection
S876914 03/23/2021 Deficient BMP Implementation Inspector identified BMPs that required maintenance. Dischargers are required to inspect their site weekly to identify BMPs that need maintenance. The City of San Marcos Response to March 23, 2021, Inspection Report did not include supporting documentation or inspection checklists showing that inspections were performed identifying that maintenance activities may be necessary. Based upon the lack of supporting documentation, the lack of BMP maintenance, and the failure to identify Project areas requiring BMPs, weekly inspections were not properly performed as required by the CGP. S876912 03/23/2021 Deficient BMP Implementation The inspector observed several material stockpiles (gravel and soil) without being covered and bermed. The Discharger in response to the San Diego Water Board inspection report stated that the stockpiles were “active” at the time of the inspection and according to an email sent May 18, 2021, the stockpiles were removed on April 6, 2021 (see Attachment C). The San Diego Water Board disagrees that the stockpiles were “actively being used.” During the inspection there was no evidence that the material stockpiles were “actively being used;” therefore, pursuant to the CGP the stockpiles must be covered and bermed. S876913 03/23/2021 Deficient BMP Implementation Inspector observed unmaintained construction entrance/exit BMPs at a Project entrance/exit. Although the entrance/exit has two shaker plates, the shaker plates are not aligned, and the gravel is insufficient to stabilize the entrance/exit sufficiently to control erosion and sediment discharges from the Project. The Discharger, in response to the San Diego Water Board inspection report, stated that the entrance/exit BMPs received maintenance on April 14, 2021. Violation B Inspection
