On 17 September 2020 Board staff issued a Notice of Violation for Sanitary Sewer Overflows (attached). That letter describes violations of the CS General Order related to three releases of sewage or wastewater effluent to Mule Creek totaling 77,727 gallons in the last 30 months. That letter required the flowing corrective actions in order to bring the Discharger back into compliance with the related requirements of the WDRs:
1. No later than 15 October 2020, submit a statement, certified by the Chief Plant Operator, that the SCADA system and MCIC lift station has been inspected and repairs/corrections have been made to ensure an issue similar to what caused the spill on 10 August 2020 will not occur in the future.
2. No later than 15 October 2020, submit the current Sanitary Sewer Management Plan (SSMP) for the facility.
The submittal did not include the current Sanitary Sewer Management Plan for the facility as required. Instead, it included an incomplete copy of the 2020 Sanitary Sewer Management Plan Biennial Audit Report covering 1 July 2018 to 30 June 2020. This does not satisfy the requirement of Item 2. The CS General Order also requires the SSMP to be uploaded to the California Integrated Water Quality System. Board has queried the database and determined that it has not been uploaded.
Attempted Communication with Discharger
After reviewing the submittal and determining that it was deficient, Board staff attempted to contact the Discharger on four occasions to rectify the issue without further enforcement. Two voicemails were left for the Chief Plant Operator at the Waste Water Treatment Plant Office. Additionally, two emails were sent, one to the submitter of the NOV Response and one to the Supervisor that completed the audit that was submitted. Board staff did not receive any responses. |
