Per Section 4.1.1 of the WDR, the 3-month rolling average waste load allocation (WLA) based final effluent chloride limitation set forth in Resolution R4-2014-010 became effective after startup of the UV and MF/RO (i.e., Advanced Water Treatment Facility, AWTF) projects at the Valencia WRP and expiration of a time schedule order (TSO). By November 2023, the UV and AWTF projects started up and TSO expired. Thereafter, the WLA-based final limitation became applicable. However, at the request of Regional Board staff on January 30, 2024, who have a different interpretation of the WDR, the limit was recalculated and compliance assessed using two-month average for December 2023. Based on the plain language of the WDR, the Sanitation District believes reporting compliance with this limitation should not occur until January 2024, when three months of flow and chloride data post AWTF startup are available to calculate the limitation, as specifically prescribed in the WDR. In December, the monthly average effluent chloride was 104 mg/L which exceeds the final effluent chloride limit following Regional Board's interpretation, 100 mg/L. Furthermore, the Sanitation District entered a 30-day testing and adjusting period, as documented in the Operations Plan submitted to the Regional Board on October 12, 2023, pursuant to the requirements in Water Code section 13385(j)(1)(D), which states that mandatory minimum penalties (MMPs) may not apply when a wastewater treatment unit is undergoing a 30-day period of adjusting or testing and certain conditions are met. The monitoring results and details on process operations during the period were summarized and submitted to the Regional Board on December 29, 2023, and a revised report on February 23, 2024. As such, the Sanitation District respectfully requests that MMPs not be applied to the December 2023 exceedance, which include data from the testing and adjusting period in November. |

Order Conditions |
An unauthorized recycled water discharge of approximately 63,000 gallons occurred on July 22 near the intersection of The Old Road and Valencia Boulevard. The discharge was due to a car accident which sheared a SCVWA recycled water air vacuum valve. Soon after the accident, SCVWA staff arrived onsite and began assessing how to isolate the valve. Due to the location of the leak, it could not be immediately isolated. The discharge likely traveled approximately 1.12 miles in the storm drain and discharged into the Santa Clara River. No adverse effects were observed, nor would they be expected because the discharge was disinfected tertiary treated recycled water and any residual chloride would have dissipated due to contact with substances exerting chlorine demand along the discharge route. SCVWA reported the discharge to the Sanitation District at 1:43 p.m. on July 24, and the Sanitation District notified the Regional Board via email at 3:55 p.m. on July 24 with a follow-up phone call at 3:39 p.m. on July 25. SCVWA submitted a written report to the Regional Board on July 27. |
Because the unauthorized discharge was caused by an unforeseen car accident, no preventative measures can be implemented to prevent reoccurrence. |

Per Section 4.1 of the MRP, continuous monitoring of total chlorine residual shall serve as a trigger for increased grab sampling for total chlorine residual excursions of up to 0.3 mg/L lasting more than 15 minutes. On November 1, the UV system was shutdown and all effluent flow was routed to the chlorine contact tanks (CCTs) for disinfection. During the transition, the metered final effluent total chlorine residual was between 0.1 and 0.3 mg/L for approximately 21 minutes which triggered grab sampling. A sample was collected; however, analysis of the grab sample did not follow analytical method protocol and, as a result, the non-detect result was not reportable. Despite this, sodium bisulfite, the dechlorination chemical, was dosed more than the stoichiometric amount needed to fully dechlorinate the effluent; therefore, the effluent was fully dechlorinated. To prevent this issue from re-occurring, the Sanitation District plans to implement procedures to ensure sample collection and analysis follow analytical method protocol. |
