Order Conditions |
According to the Standard Provision I.D, ¿The Discharger shall at all times properly operate and maintain all facilities and systems of treatment and control (and related appurtenances) which are installed or used by the Discharger to achieve compliance with the conditions of this Order.¿ During the inspection, Board staff noted that the treatment system¿s inlet was clogged, and the influent water was overflowing over and around the sandbags, bypassing the treatment system. According to the Discharger, the inlet may have been clog-up due to excessive sediment buildup. The Discharger stated that the sediment buildup will be cleared soon. The bioreactor components were found in disrepair and unlikely to be operating as designed during previous inspections. Board staff did not observe any modification or improvement in the condition of the treatment system during this inspection. Not maintaining the treatment system¿s inlet and the bioreactor does not allow proper treatment of the wastewater and is a violation of the Standard Provision I.D. |

According to the WDRs¿ Discharge Prohibitions III.A, ¿Discharge of mining waste from the Facility, as the Facility is specifically described in the Fact Sheet in section II.B, in a manner different from that described in this Order is prohibited.¿ Even though there was no discharge to surface water at the time of the inspection, based on observations made during the inspection, effluent was being discharged in a manner different than what is described by the Order. Board staff observed effluent infiltrating and soil erosion and a narrow flow path which may have been formed from basin runoff to the surface water. |
