On June 7, 2023, the Discharger allegedly discharged 471,100 gallons of partially primary-treated process wastewater to a water retention area hydrologically connected to McNabney Marsh. The discharge occurred as a result of a break in a cement-encased pipeline that was not discovered until water was observed spilling from the section of the pipeline where the break occurred. The Discharger was unable to clean up 328,314 gallons of the unauthorized discharge. |

On July 29, 2022, MRC sampled for coliform at EFF-001D as dictated by its random sampling schedule. The sample was sent to a contract laboratory, but the driver did not deliver the sample within the 8-hour hold time. MRC was notified of the hold time exceedance on Monday, August 1, 2022. The compliance week as defined in Order R2-2017-0039 is Sunday to Sunday meaning that MRC was not able to take an additional sample to meet the weekly monitoring requirements for coliform for the week of July 24, 2022. The coliform analysis for the July 29 sample was completed but it was not reported in CIWQS due to the qualifier of not meeting regulatory hold time requirements; the result was 2 MPN/100 mL.
MRC verbally notified the Regional Water Quality Control Board of the monitoring deficiency on Monday, August 1, 2022. |
MRC completed an informal investigation to address the deficiency. MRC¿s internal analytical laboratory, which is responsible for managing compliance sampling, has updated their random sampling calendar to ensure that samples are sent earlier in the week to allow adequate time for resampling as necessary. MRC has also requested additional communication from the contract laboratory for sample receipt and preparation as an interim measure until the contract lab completes their investigation and develops and implements corrective actions. |

On January 8, 2021, the Regional Water Board Executive Officer directed MRC to submit the technical report by February 1, 2022, pursuant to Water Code section 13383. The report required technical information on the Facility’s vulnerabilities to sea-level rise, groundwater rise, changing climate, and power outages, and associated adaptation strategies. On January 25, 2022, MRC requested a four-month extension of the deadline to June 1, 2022. The Executive Officer granted this request on January 27, 2022. However, MRC did not meet the extended deadline and did not submit the technical report until October 10, 2023. |
