Order Conditions |
On May 16 2023 Santa Ana Regional Water Quality Control Board (Santa Ana Water Board) staff received a complaint reporting extremely turbid conditions in San Timoteo Creek Reach 3B at the railroad crossing near the Redlands Hospital in the City of Redlands. On May 19 2023 Santa Ana Water Board staff performed an inspection of a portion of the flood control basins and structures within Reach 3B of San Timoteo Creek in response to the complaint. Looking downstream at San Timoteo Creek from the San Timoteo Canyon bridge the water was muddy. The Discharge Specifications in WDRs Order No. 01-75 state neither the project nor the discharge of waste shall create or threaten to create a nuisance or pollution as defined by Section 13050 of the California Water Code Additionally section B.3 of the Order prohibits the discharge of silt sand clay or other earthen materials from any activity to cause deleterious bottom deposits turbidity or discoloration in surface waters. The muddy flow in San Timoteo Creek is a violation of the above Order requirements. At the first flood control basin (upstream) Santa Ana Water Board staff observed several shallow and wide streams braiding over the basin which was full of silt and sediment. The water flow appeared muddy and thick this is a violation of section B.3 of the Order which prohibits the discharge of silt sand clay or other earthen materials from any activity to cause deleterious bottom deposits turbidity or discoloration in surface waters. At the last flood control basin (downstream) an excavator was removing and moving sediment within the basin and surface waters. Santa Ana Water Board staff observed sediment and dirt stockpiled within the basin and along the banks of San Timoteo Creek in upland areas. The water within the basin was muddy and thick where the excavator was working; this violates Section B.2 Prohibitions of the WDRs Order, which prohibits the discharge of waste to any drainage areas, channels, or streams. Additionally, the WDRs prohibit spoil sites be located within any streams or in areas where it could be washed into any surface water body. Additionally the Discharger shall comply with the WDRs Monitoring and Reporting Program and is required to notify the Santa Ana Water Board in writing or by phone three weeks before any maintenance operations are implemented in San Timoteo Creek. In addition to the violations observed during the inspection, the San Bernardino County Flood Control District has failed to comply with the reporting and monitoring requirements specified in the Order. |
