Discharge of waste constituents to the unsaturated zone. - In 2025, volatile organic compounds (VOCs) were detected in the following unsaturated zone gas probes located just outside the limits of the Facility’s WMUs; GP-IA-3(D), GP IIA 1(S), GP IIA 1(M), GP IIA 2(M), GP IIIA 2(M), GP IIIA 2(D), GP IIIA 4(M), GP-IIIA-4(D), GP-IIB-2(M), GP-IIB-2(D), GP-IIIB-1(M), GP-IIIB-1(D), GP-IIIB-2(M), and GP-IIIB-2(D). Additionally, methane was detected in GP-IIA-1(S) and GP-IIA(M) in February 2025 at 29.8% and 19.3% by volume, respectively. Concentrations fell below 5% by August 2025; however, VOCs persisted in the TO-15 samples collected from these gas probes. |

Violation 1 - Unauthorized discharge of contact storm water/leachate to surface waters of the state:
1. Prohibition 2 of the WDRs states; The discharge of wastes outside of a Unit or portions of a Unit specifically designed for their containment is prohibited.
2. Prohibition 10 of the WDRs states; The discharge of solid or liquid waste or leachate to surface waters, surface water drainage courses, or groundwater is prohibited.
3. Discharge Specification B.3 of the WDRs states; During wet weather conditions, the facility shall be operated and graded to minimize leachate generation.

According to the Discharger, repairs to the damaged Phase III-A solid WMU containment berm were complete by 30 January 2024. However, the extent of the release and its impact must now be assessed, and if needed corrective action implemented. Therefore, to assess potential impacts to surface water downstream of the Phase III-A solid WMU release point, surface water samples are to be collected from Sedimentation Basins #1 and #2. Each of these samples are to be analyzed for VOC, SVOCs, arsenic and the other Monitoring Parameters outlined in Table 1 of the MRP, which includes total dissolved solids, chloride, carbonate, bicarbonate, nitrate - nitrogen, sulfate, calcium, magnesium, potassium, and sodium. The laboratory results from this analysis are to be submitted along with a summarized table of the results comparing them to the previous results provided in your 13 March 2023 email in a report due no later than 30 May 2024. |

Violation 1 -Unauthorized discharge of waste/leachate into the newly completed Phase III Class II surface impoundment without final approval of the WMU by Central Valley Water Board staff:
1. Design And Construction Specifications D.12 of the WDRs states: The Discharger shall submit a final report documenting construction of any new lined WMU for review and approval prior to discharging wastes to the WMU. The Discharger must also submit an additional technical report as part of its final construction report demonstrates that certifies that any testing required and any limitations or additional requirements specified in the final closure cover or base and side slope liner’s slope stability analysis report was complied with during construction in order to validate the slope stability analysis report conclusions.
2. Section 20310(e) of Title 27 states: Containment structures shall be designed by, and construction shall be supervised and certified by, a registered civil engineer or a certified engineering geologist. Units shall receive a final inspection and approval of the construction by RWQCB or SWRCB staff before use of the Unit commences.

1. Continue weekly reporting of the leachate and freeboard levels in the Phase III Class II surface impoundment as well as: 1) the level of leachate in the leak detection system (LSD), 2) volume of leachate removed from the LDS, 3) the action leakage rate, 4) the level of leachate detected within and volume removed from the surface impoundment lysimeter, and 5) the volume of leachate pumped into the Phase III Class II surface impoundment until the January 2024 CQA Report is approved by Central Valley Water Board staff.
2. Addtinaly, since receiving final CQA approval from Central Valley Water Board staff is often an iterative process, the Discharger must continue to work in good faith with the Central Valley Water Board’s Permitting Unit to achieve approval of both the Phase III-A solid WMU and the Phase III Class II surface impoundment.

Violation 3 - A buildup of hydraulic head on the underlying Primary liner of the Phase III-A solid WMU.
1. Design And Construction Specifications D.6 of the WDRs states in part: LCRSs shall be designed, constructed, and maintained to collect twice the anticipated daily volume of leachate and gas condensate generated by each Class II surface impoundment and/or landfill WMU and to prevent the buildup of hydraulic head on the underlying liner at any time.
2. Design And Construction Specifications D.8 of the WDRs states: The LCRS for each Class II unit shall be operated and maintained to collect twice the anticipated daily volume of leachate and gas condensate generated by the WMU and to prevent the buildup of hydraulic head on the underlying liner at any time. The depth of fluid in the LCRS sump shall be kept at the minimum needed to ensure efficient pump operation.
3. Section 20340(c) of Title 27 states: Head Buildup -The RWQCB shall specify design and operating conditions in WDRs to ensure that there is no buildup of hydraulic head on the liner. The depth of fluid in the collection sump shall be kept at the minimum needed to ensure efficient pump operation.

1. Continue weekly reporting, by email, of the leachate level in and the volume of leachate removed from the Phase III-A solid WMU, which includes reporting for: 1) The primary LCRS, 2) the secondary LCRS and 3) the sub drain system, until the January 2024 CQA Report is approved by Central Valley Water Board staff.
2. Submit a work plan no later than 1 June 2024 to make improvements to the pumps, piping runs, and/or leachate collection sumps of the Phase III-A solid WMU’s LCRS to ensure it can be operated and maintained to collect twice the anticipated daily volume of leachate and gas condensate generated by the Facility’s WMUs to prevent a buildup of hydraulic head on the underlying primary liner, as required by the WDRs.
3. Submit a report no later than 30 September 2024 demonstrating the approved improvements have restored full compliance with the WDRs. Included in the report shall be photographs of the completed improvements approved by the Central Valley Water Board staff. The documentation should include as-built drawings as well as the amended water balance that demonstrates that the capacity of each pipe, piping run, LCRS sump, gas condensate sump have been properly sized to meet the requirements in the WDRs and Title 27.

1) Submit a Final Construction Quality Assurance (CQA) Completion Report for the Phase III-A solid WMU, completed in accordance with Section 20324 of Title 27, as required by Construction Specifications D.12 of the WDR and Section 20310(e) of Title 27.
2) Begin monitoring the Phase III-A solid waste MWU and all required leachate, soil gas, vadose zone, and groundwater monitoring points associated with the Facility in accordance with all applicable sections of the WDRs and MRP.
3) Begin weekly reporting of the leachate level in and the volume of leachate removed from the Phase III A and all solid WMU: 1) LCRS systems, 2) Secondary geocomposite drainage layers, and 3) Lysimeters.
Further, should Central Valley Water Board permitting staff’s review of the final Phase III CQA document or their final inspection reveal that the Phase III A solid WMU was not constructed as required and conditionally approved, the removal and reinstallation of the entire Phase III A solid WMU may be necessary to correct any identified construction defects. |
