On June 25, 2025, Receiving Stream natural temperature was measured to have increased beyond the allowable increase of 5°F between RSW-001 and RSW-002 set forth in Section VI.A.16.a of Order R5-2017-0085-01. It was not recognized upon sampling and there was no further investigation into the cause that day. |
Upon monitoring of Receiving Streams on July 2, 2025, it was noticed that RSW-002 temperatures varied from 61.5°F to 67.8°F depending on specific sample location at RSW-002. Due to low flows, weather influences, rock temperature influences, stream convergence and access to sampling areas, temperature can vary greatly in approximately 25 feet of sampling access. RSW-001 on this day was measured at 62.4°F. Had we used the lowest temperature reading obtained at RSW-002 it would have been lower than RSW-001. Had we used the highest reading at RSW-002 it would have put us in violation. We took four samples at RSW-002 which read 61.5°F, 64.8°F, 65.3°F and 67.8°F. Based upon our observations we removed the last reading of 67.8°F based upon the fact that it was the furthest from our discharge point and in a large stagnant pool downstream. We averaged the other three readings and used that average as our RSW-002 temperature reading at 63.9°F. To ensure accuracy and consistency, temperature sampling at RSW-002 will now be an average of all readings taken when temperature differences exist in the sampling area. |

This lapse in communication resulted in missing continuous monitoring data. August 9th-10th, effluent flow data is missing. August 9th and August 12th, effluent continuous monitoring data is incomplete for pH, NTU, UVT and UV Dose. August 10th-11th, effluent continuous monitoring data is missing for pH, NTU, UVT and UV Dose.

Upon return the following Monday, during readings, this discovery was made and corrected. |

The Discharger violated the Pond Operating Specifications for minimum freeboard. The Discharger indicated the low freeboard measured in Pond 1 on 1 January 2023 and 2 January 2023 and was due to excessive rainfall that occurred during the December 2022 and January 2023 storms. |
Reviewed the compliance criteria with Discharger to clarify the point of compliance is the lowest point of overflow of the pond, not the top of berm. |

The INF-001 Total Suspended Solids sample number GEJ0190-03 taken on 10/05/2022 was not analyzed properly at the lab due to a lab accident as stated by the lab. The sample was retested but had exceeded the hold time of that sample. |
