Tesoro promptly discontinued the discharge and verbally notified the RWQCB of the chronic toxicity failure. Tesoro instructed the analytical laboratory (Enthalpy Analytical) to conduct a Toxicity Identification Evaluation (TIE) using the remaining sample at the lab. Prior to initiating the TIE the laboratory analyzed the sample again for chronic toxicity which the sample passed and the TIE was discontinued. A TIE cannot be conducted once a sample is not toxic. Tesoro will implement the accelerated monitoring program during the first hour of the next discharge. The accelerated monitoring schedule will consist of a five concentration dilution series which includes the control with five dilutions, one of which will be the In-stream Waste Concentration (IWC). The testing will be repeated up to a maximum of four times, conducted in approximately two-week intervals as long as discharging continues and the chronic toxicity test results in a ¿Fail¿. |
