1134394 12/31/2023 DMON According to the NOA Table 2, the Discharger is required to monitor daily flow rate, pH, turbidity, temperature, and dissolved oxygen (DO) on a weekly basis. For the Fourth Quarter of 2023, however, the Discharger only reported a single data point for October, without specifying the exact days of discharge to surface water. 1134395 12/31/2023 Order Conditions According to WDRs R5-2022-0006-02, Provision IX.C.2.b, the numeric toxicity monitoring trigger for initiating accelerated monitoring is >1 TU. This trigger is not an effluent limitation but rather a threshold that requires the Discharger to begin accelerated monitoring. In the Fourth Quarter of 2023, the chronic toxicity test for Ceriodaphnia dubia exceeded the numeric trigger of 1 TUc, with reported results at <1.3 TUc. However, the Discharger did not initiate accelerated monitoring, which constitutes a violation of the order condition. Accelerated monitoring contains conducting two additional chronic toxicity tests on the species that exceeded the trigger of 1 TUc, using a 6-week median to evaluate compliance. If the 6-week median exceeds 1.3 TUc (as 100/EC25 or 100/IC25) and the percent effect is greater than 25 percent at 100 percent effluent, the Discharger must demonstrate to the satisfaction of the Executive Officer that the discharge is not causing chronic toxicity in the receiving water to maintain coverage under this Order. Failure to initiate accelerated monitoring is a violation of the WDRs. Violation B Report
