California Water Code section 13385(i) requires that a mandatory minimum penalty (MMP) of $3,000 be assessed for each non-serious violation, not counting the first three violations unless any of the defenses in section 13385(j) apply. This violation does not seem to be subject to MMP, should Board staff determine that this violation is subject to MMPs, an additional notification will be provided. |

According to MRP Provision IX.D.1, from December 2020 through March 2021 the Discharger must conduct monthly effluent and receiving water characterization sampling, regardless of a discharge to Angels creek. However, the Discharger failed to conduct effluent and receiving water characterization. The Discharger was under the impression that no sampling was required when not discharging to surface water. In order to have sufficient data for permit renewal, please conduct monthly effluent and receiving water characterization sampling as required in the permit. |
