THIS STOCKPOND IS FILLED FROM A SPRING THAT RISES ON OUR PROPERTY, THE WATER GOES IN THE POND AND RIGHT BACK DOWN THE WATER COURSE. THE POND IS USED FOR LIVESTOCK, WILDLIFE, RECREATION AND WAS USED BY THE USFS A COUPLE SUMMERS AGO TO HELP WITH HUGES FIRES, ONLY WATER SOURCE IN A VERY LARGE AREA. THE POND HAS ABOUT 1/4 ACRE SURFACE AND HOLDS LESS THAT AN ACRE FOOT OF WATER. I WOULD CONSIDER THE USE TO BE NONCONSUMPTIVE WITH THE WATER GOING IN AND RIGHT BACK OUT. I TALKED TO SCOTT MCFARLAND ON 3/29/2017 WITH YOUR DEPT AND HE EXPLAINED THAT AS I THOUGHT THE WATER IS CONSIDERED NONCONSUMPTIVE. THE POND ORIGINALLY FILLED AND HAS STAYED FULL WITH THE SPRING EVEN THROUGH THE LAST DROUGHT. |
