Unauthorized Discharge |
Water Code section 13264 violation. The discharges of industrial cannabis wastewater to a stormwater basin at the facility are not permitted under the Cannabis General Order, nor has a RoWD been received by the Lahontan Water Board, as required by Water Code section 13260. The actual discharges of waste observed during the March 27th, 2024, inspection is therefore a violation of Water Code section 13264. |

13264 - Active fertigation of cannabis plants as evidenced by wetted areas beneath the plants. Fertigation liquids contain wastes that are transported through soils and could affect the quality of waters in the nearby ephemeral stream course and/or groundwater. Cannabis plants growing directly in the ground supported by soils added by the cultivator contain wastes that could be transported by fertigation liquids and affect groundwater. - Site grading of the subject property, which disturbs native soils and generates sediments, has resulted in the discharge of soil/sediment into the ephemeral stream channel identified in this report. - Domestic wastewater discharged from the shower/latrine area directly to land. Domestic wastewater contains pathogens, organic materials, nutrients, metals, and other inorganic materials. Wastewater discharged to land may cause domestic wastewater constituents to infiltrate through native soil transporting constituents of the waste to groundwater and/or surface water. - Trash and other cultivation-related debris placed directly in the ephemeral stream channel present at the subject property. Trash and cultivation-related debris are wastes, and their presence in the ephemeral stream channel amounts to a discharge of waste to surface water. |

13260 - Application of fertigation liquids containing fertilizers or pesticides. Active fertigation was evidenced by wetted ground around the cannabis plants. - Unsecured storage of fertilizers, pesticides, insecticides, petroleum products and related equipment without secondary containment, and unsecured storage of trash, and other cultivation related materials. - Placement of cultivation media and/or cultivation soils directly in the ground. - Site grading which disturbs native soils and sediments. Soils and sediments may be mobilized during fertigation or precipitation events and could impact waters of the State. |

Actual discharges of wastes to waters of the State from activities associated with cannabis cultivation observed at the site include: - Domestic wastewater discharged directly to land. Domestic wastewater may contain pathogens, organic and inorganic materials, nutrients, and metals which could infiltrate through soils and transport wastes to groundwater. - An unknown liquid from an unlabeled container found in the vicinity of containers of pesticides, insecticides, and fertilizers discharged directly to land which could infiltrate through native soils and transport wastes to groundwater. |

13260 Threatened discharges of wastes to waters of the State from activities associated with cannabis cultivation observed at the site include: - Unsecured storage of fertilizers, pesticides, insecticides, and petroleum products without secondary containment which could result in a discharge of waste to groundwater. - Unauthorized releases of water from two unpermitted storage ponds could result in a discharge of waste to groundwater. - Application of irrigation water and other fertigation liquids to cannabis plants growing directly in the ground. Irrigation waters deliver fertilizers, pesticides, and insecticides that could infiltrate through cultivation media and native soils and transport waste constituents to groundwater. |

13264 Actual discharges of wastes to waters of the State from activities associated with cannabis cultivation observed at the site include: - Recent application of irrigation water and other fertigation liquids to cannabis plants delivering fertilizers, pesticides, and insecticides that can infiltrate through cultivation media and native soils and transport waste constituents to groundwater. - Domestic wastewater discharged directly to land. Domestic wastewater may contain pathogens, organic and inorganic materials, nutrients, and metals which could infiltrate through soils and transport wastes to groundwater. - Petroleum equipment with no secondary containment within 100 feet of an ephemeral stream channel. The ground around two generators and a collection of petroleum product containers was stained by some type of liquid. Staff conclude this liquid was petroleum based. Discharges of this type of liquid to land could affect groundwater and/or surface water. |

13260 - threaten to discharge waste without submitting ROWD. - Application of fertigation liquids containing fertilizers or pesticides. Active fertigation was evidenced by wetted ground around the cannabis plants Unsecured storage of fertilizers, pesticides, insecticides, petroleum products and petroleum-based equipment without secondary containment. - Placement of cultivation media and/or cultivation soils directly in the ground to promote plant growth. Cultivation media contains wastes which threaten to discharge to groundwater during fertigation and precipitation events. - Site grading activities within 70 feet of an ephemeral stream channel. Site grading generates sediments which are delivered to surface waters during cultivation activities and environmental factors such as wind or precipitation events. - Unsecured storage of trash and cultivation-related debris which could be discharged to the nearby ephemeral stream channel via environmental factors such as wind or precipitation events. |
